TERMS AND CONDITIONS

These terms and conditions govern the use of www.frontandcompany.com, which is an ecommerce website owned and operated by Front and Company Enterprises Ltd.

1. ACCEPTANCE OF TERMS
By accessing or using the website located at www.frontandcompany.com (the "Site"), operated by Front & Company Enterprises Ltd. ("Front & Company," "we," "our," or "us"), you indicate that you have read and understand these Terms and Conditions ("Terms") and agree to abide by them at all times.

2. OWNERSHIP AND INTELLECTUAL PROPERTY RIGHTS
All materials, including but not limited to text, graphics, images, logos, icons, documents, and other content on the Site (collectively, "Content"), are the property of Front & Company or its licensors, unless otherwise indicated. You may not copy, modify, reproduce, republish, upload, post, transmit, or distribute the Content in any form or by any means, including electronically or mechanically, without the express written consent of Front & Company.

3. LIMITED LICENSE AND AGE RESTRICTIONS
Subject to your compliance with these Terms, Front & Company grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Site solely for your personal, non-commercial use. Any unauthorized use of the Site or its Content may result in the termination of your access to the Site.

The minimum age to use our Site is 13 years old. By using this Site, users agree that they are over 13 years old. We do not assume any legal responsibility for false statements about age.

Users under the age of 18 may access our Site, but only with the supervision of a parent or legal guardian. By using this Site, users under 18 confirm that they have obtained consent from a parent or legal guardian, who is responsible for their access to and use of the Site.

4. ACCOUNTS
When you create and account on our Site, you agree to the following:

  • You are solely responsible for your account and the security and privacy of your account, including passwords or sensitive information attached to that account; and
  • All personal information you provide to us through your account is up to date, accurate, and truthful and that you will update your personal information if it changes.

We reserve the right to suspend or terminate your account if you are using our Site illegally or if you violate these Terms.

5. SALE OF GOODS
These Terms govern the sale of goods available on our Site. These Terms apply to all goods that are displayed on our Site at the time you access it. This includes all products listed as being out of stock. All information, descriptions, or images that we provide about our goods are as accurate as possible. However, we are not legally bound by such information, descriptions, or images as we cannot guarantee the accuracy of all goods we provide. You agree to purchase goods from our Site at your own risk.

We reserve the right to modify, reject or cancel your order whenever it becomes necessary. If we cancel your order and have already processed your payment, we will give you a refund equal to the amount you paid. You agree that it is your responsibility to monitor your payment instrument to verify receipt of any refund.

6. SHIPPING AND DELIVERY
When you purchase goods from our Site, the goods will be delivered through one of the following methods:

  • Standard delivery by post. Delivery takes 5-7 business days, unless stated otherwise.
    Delivery will take place as soon as reasonably possible, depending on the delivery method selected. Delivery times may vary due to unforeseen circumstances. Please note that delivery times do not include weekends and statutory holidays.

You will be required to pay delivery charges in addition to the price for the goods you purchase.

If you purchase goods from us for delivery to a destination outside Canada, your purchase may be subject to import duties and taxes applied by the destination country. You may be responsible for paying any such duties or taxes. Please contact your local customs office for more information before making a purchase. We are not responsible for the payment of any such duties or taxes and are not liable for any failure by you to pay them.

You are required to provide us with a complete and accurate delivery address, including the name of the recipient. We are not liable for the delivery of your goods to the wrong address or wrong person as a result of you providing us inaccurate or incomplete information.

7. RETURNS AND REFUNDS
Refund requests must be made within 14 days after receipt of your goods.

We accept refund requests for goods sold on our Site for any of the following reasons:

  • Good is broken;
  • Good does not match description;
  • Good is the wrong size;
  • Purchaser changed their mind; or
  • Good does not meet the purchaser's expectations.

Refund requests do not apply to consignment items and are not eligible for returns, refunds, or exchanges

Refunds do not apply to the following goods:

  • Sale items;
  • Gift certificates;
  • Hair accessories;
  • Socks;
  • Underwear; and
  • Shipping and handling charges 

Refund requests are subject to review by Front & Company and may be approved or denied at our discretion, based on the specific circumstances of the request.

8. THIRD PARTY GOODS AND SERVICES
Our Site may offer goods and services from third parties. We cannot guarantee the quality or accuracy of goods and services made available by third parties on our Site.

9. INDEMNIFICATION
Except where prohibited by law, by using this Site, you agree to indemnify, and hold harmless Front & Company and our directors, officers, agents, employees, subsidiaries, and affiliates from and against any actions, claims, losses, damages, liabilities, and expenses including legal fees arising out of or related to your use of the Site or any violation of these Terms.

10. LIMITATION OF LIABILITY
Front & Company and our directors, officers, agents, employees, subsidiaries, and affiliates will not be liable for any actions, claims, losses, damages, liabilities, and expenses including legal fees from your use of the Site. Front & Company makes no representations or warranties regarding the functionality or availability of the Site, and shall not be held liable for any temporary or permanent disruptions or malfunctions of the Site or its services.

11. APPLICABLE LAW
These Terms are governed by the law of the Province of British Columbia.

12. PERSONAL INFORMATION AND PRIVACY
By using the Site, you agree that Front & Company may collect and use personal information in accordance with applicable privacy laws. Front & Company has no control over these websites and is not responsible for the content, services, or availability of these external sites. 14. DISCLAIMER OF WARRANTIES
THE SITE AND ALL CONTENT THEREIN ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. FRONT & COMPANY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. FRONT & COMPANY DOES NOT WARRANT THAT THE SITE WILL BE ERROR-FREE OR UNINTERRUPTED, OR THAT THE SITE WILL MEET YOUR REQUIREMENTS.

15. PRICING AND AVAILABILITY
All pricing information on the Site is subject to change without notice. In the event of an error in the pricing or availability of an item, Front & Company reserves the right to cancel or refuse an order placed at the incorrect price or for an unavailable item. In such cases, Front & Company will promptly notify you and offer a full refund or adjustment.

16. CONSUMER PROTECTION LAW
Where the Business Practice and Consumer Protection Act, or any other consumer protection legislation in your jurisdiction applies and cannot be excluded, these Terms will not limit your legal rights and remedies under that legislation. These Terms will be read subject to the mandatory provisions of that legislation. If there is a conflict between these Terms and that legislation, the mandatory provisions of the legislation will apply.

17. TERMINATION
Front & Company reserves the right, in its sole discretion, to terminate or suspend your access to the Site at any time, for any reason, including but not limited to a violation of these Terms. Upon termination, you must immediately cease all use of the Site, and Front & Company may, at its sole discretion, disable your account.

18. SEVERABILITY
If at any time any of the provisions set forth in these Terms are found to be inconsistent or invalid under applicable laws, those provisions will be deemed void and will be removed from these Terms. All other provisions will not be affected by the removal and the remaining provisions will continue and still be considered valid.

19. ENTIRE AGREEMENT
These Terms, along with our Privacy Policy and any other legal notices or agreements published on the Site, constitute the entire agreement between you and Front & Company regarding the use of the Site.

20. CHANGES TO THE TERMS OF USE
These Terms may be amended from time to time in order to maintain compliance with the law and reflect any changes to the way we operate our Site and the way we expect users to behave on our Site. Front & Company reserves the right to modify, update, or amend these Terms at any time without notice. All changes will be posted on the Site, and the revised Terms will be effective immediately upon posting. Your continued use of the Site following such changes constitutes your acceptance of the updated Terms.
